Acceptable Use Policy
This policy describes permitted and prohibited uses of services provided by Sales Club Group LLC. It applies to all clients, engagements, and website visitors. It exists alongside, and is incorporated into, our Terms of Service.
1. Purpose
Sales Club operates within strict regulatory and banking constraints. Our payment processor and our business-banking provider impose acceptable-use requirements on every business relationship they support, and those requirements flow through to our clients. This policy makes those constraints explicit.
2. Permitted use
Sales Club services are for businesses that operate lawfully in the United States in industries we serve. We currently focus on:
- Med spas and aesthetic-medicine clinics
- Aesthetics studios (lash, brow, premium salons)
- Dental practices
- Fitness and wellness studios
- Professional services (financial advisors, insurance, law, coaching)
- Home services (HVAC, solar, roofing, remodeling)
We may decline engagements outside these verticals based on capacity and capability.
3. Prohibited uses
You may not use our services to:
- Violate any applicable law or regulation in any jurisdiction where you operate or where Sales Club operates.
- Make false, deceptive, or misleading claims about products, services, pricing, qualifications, certifications, or endorsements.
- Send unsolicited commercial messages in violation of the CAN-SPAM Act, TCPA, or equivalent regulations in other jurisdictions.
- Violate manufacturer minimum-advertised-price (MAP) agreements where they apply.
- Engage in deceptive trade practices, bait-and-switch tactics, or undisclosed paid endorsements that violate FTC guidelines.
- Solicit, collect, or process personal information of minors without verified parental consent.
- Discriminate against any protected class in violation of federal, state, or local law.
- Use creative assets, brand assets, or testimonials that you do not have the right to use.
- Submit fabricated or solicited fake reviews, or engage in any review manipulation prohibited by FTC guidance.
4. Prohibited industries and offers
Independent of vertical focus, Sales Club does not work with businesses whose primary offering involves:
- Adult content, services, or merchandise
- Firearms, ammunition, or weapons accessories
- Recreational drugs, drug paraphernalia, or cannabis products that are not federally legal
- Gambling, sports betting, or fantasy-sports operators
- Multi-level marketing, pyramid structures, or income-opportunity offers
- Payday lending, debt-relief schemes, or credit-repair services
- Cryptocurrency trading platforms, ICOs, or speculative crypto offers
- Get-rich-quick programs, “guru” coaching with income claims, or income-disclaimer-light info products
- Counterfeit or trademark-infringing goods
- Telemedicine for controlled substances
- Any activity prohibited by Stripe’s Restricted Businesses list or our business-banking provider’s acceptable-use terms, as amended from time to time
We may decline or terminate any engagement that, in our reasonable judgment, falls within these categories or risks the standing of our payment, banking, or hosting providers.
5. Marketing compliance
For client engagements, we operate the marketing function on the client’s behalf. Both parties share responsibility for compliance:
- The client warrants that all claims, certifications, credentials, and license numbers provided to Sales Club for use in campaigns are accurate and current.
- Sales Club is responsible for the technical compliance of campaigns (CAN-SPAM headers, opt-out mechanics, ad-platform policy alignment, FTC disclosure formatting where applicable).
- Health-vertical clients warrant that any health, safety, or medical claims used in creative are supported by competent and reliable scientific evidence as required by FTC guidance.
6. Enforcement
We may, at our sole discretion and without notice:
- Pause or remove campaigns that we reasonably believe violate this policy.
- Suspend access to any related service or platform we operate on the client’s behalf.
- Terminate the engagement, with or without refund of any unbilled fees, depending on the nature of the violation.
- Report violations to law enforcement, regulators, or platform providers where required by law.
7. Reporting violations
If you believe a Sales Club client or campaign is operating in violation of this policy, applicable law, or platform terms, email legal@sales-club.co with the details. We will investigate and respond within 10 business days.
8. Changes to this policy
We may update this policy from time to time, including to align with changes in our payment, banking, or platform providers’ own acceptable-use terms. The effective date at the top of this page reflects the latest version.
